Terms of Service

Note: This contract includes a limitation of liability and limitation of remedies.

You are contracting with The Blossom Grove, LLC (TBG) to produce a unique hand-crafted product involving the use of flowers and other materials. This means each product will be one-of-a-kind and will differ from your original fresh floral bouquet. By placing an order, you acknowledge the following:

1. Changes in flowers – Flowers naturally change during drying and preservation. This may include color shifts, bruises, translucent spots, bubbles in resin, or flowers shifting within the resin.

2. Pre-dried flowers – If you send flowers that you have dried in advance, TBG is not responsible for mold, rot, or hairs that may appear or emerge during preservation.

3. Moisture in pre-dried flowers – Flowers that still contain moisture cannot be successfully preserved.

4. Refrigerated or frozen flowers – Flowers stored in a refrigerator or freezer before being sent to TBG may contain rot and mold and cannot produce a satisfactory product.

5. Damaged or wilted flowers – TBG reserves the right to refuse flowers that arrive damaged or wilted, if in the opinion of TBG’s designer preservation attempts will not be successful. In such cases, TBG will not return the damaged or wilted flowers, though for an additional cost, TBG may source replacement flowers to closely approximate your original arrangement.

6. Shipping risks – TBG is not responsible for lost or damaged products caused by Acts of God, shipping carriers, or incorrect addresses provided at checkout.

7. Natural aging of materials – Resin naturally yellows or ambers over time, and flowers in resin and behind glass may lighten or darken. TBG is not liable for these natural changes.

8. Photography rights – TBG may photograph any products we create for use on social media, our website, or advertising. Photos you send to TBG may also be shared unless otherwise requested.

9. Color correction – Color correction is an optional artistic service for resin preservation. It helps reduce transparency and approximate your bouquet’s original colors but will never exactly match the fresh flowers.

10. Right to cancel – TBG reserves the right to cancel an order at its sole discretion if the client relationship or project is not a good fit for a satisfactory result.

11. Liability for injuries – TBG is not responsible or liable for any injuries sustained in relation to its products.

12. Care instructions – Hot items should never be placed directly on resin pieces.

13. Disclaimer of warranties – TBG specifically disclaims any and all warranties, including implied warranties of merchantability or fitness for a particular purpose, and any warranty arising from course of dealing, customer usage, or trade.

14. Limitation of liability – In no event shall TBG, its owners, officers, directors, employees, or agents be liable for indirect, incidental, punitive, or consequential damages of any kind. TBG’s maximum liability shall not exceed the amount paid by you for your order or actual proven damages, whichever is less. This limitation is your exclusive remedy, even if other remedies fail.

15. Legal fees – If TBG incurs legal expenses to collect payment or defend itself against claims, TBG is entitled to reasonable legal fees and costs. This contract is governed by Louisiana law.

16. Claims process – Any claim for damages must be submitted in writing within 30 days of product delivery. Claims made after 30 days are waived.

17. Severability – If any part of this contract is found unenforceable, the remaining provisions remain valid and enforceable.

18. Refunds - due to the handcrafted and custom nature of flower preservation, no refunds will be given. TBG will make every effort to satisfy customer concerns, should any arise.
